1. INTRODUCTION
1.1 TRIANGLE SERVICES
Greetings from TRIANGLE! We are more formally known as LS54 Ventures, LLC, a company incorporated in Arizona, and having a principal place of business at 9061 North 28th Street, Phoenix, AZ, but we use the name TRIANGLE for conducting business—it’s a bit catchier.
Our goal is to develop intuitive, powerful, and enjoyable mobile applications, web interfaces, and other services that benefit our users in matters pertaining to real estate. Specifically, we produce software products and provide services—or we plan to do so—for usage in the rental, residential home sale, and commercial markets. Depending upon the market or application, we may offer software application-based tools or solutions to assist with different key aspects of renting a property, to aid in managing property rentals, to help with home sales or purchases, to enhance walkthroughs or tours of homes, to provide intelligent home access for the performance of maintenance or repair services, or to assist agents in bettering serving their clients in buying, selling, or renting homes.
The term “home,” as appearing throughout this policy, encompasses not only residential structures, such as single family homes, apartments, townhomes, and condominiums, but also commercial structures, such as office space. We have chosen the word “home” for this policy to help keep our wording simple. You can consider the word “home” to encompass the commercial and residential structures.
Our mobile applications, our website (LetsTriangle.com), any social media sites owned and operated by TRIANGLE, and all of the other products and services are referred to collectively herein as “OUR SERVICES.”
1.2 WHAT’S THE PURPOSE OF THIS POLICY?
The purpose of this policy is to explain how TRIANGLE collects, shares, and uses your information when you access or use OUR SERVICES. By “your” and “you,” we are referring to OUR USERS—that is, the individuals that use OUR SERVICES.
We want you to read, understand, and feel comfortable with this policy. To best serve all our users, we have attempted to write this policy in a friendly, approachable tone, while also being thorough and forthright. 1.3 GENERALLY SPEAKING, WHAT TYPE OF DATA DOES TRIANGLE COLLECT?
Generally, we collect at least two broad categories of data: PERSONAL DATA & NON-PERSONAL DATA. Let’s define each of these terms.
PERSONAL DATA is information associated with or relating to a specific person, which may be capable of identifying a person in certain instances.
NON-PERSONAL DATA is any information that does not relate to a specific person and is generally incapable of being used to identify a person.
Next, in SECTION 2, this policy will discuss types of data TRIANGLE may collect in greater detail.
2. SPECIFIC TYPES OF DATA WE MAY COLLECT
When you use OUR SERICES, such as when you use a TRIANGLE brand mobile application executing on a smartphone, a tablet, or another portable electronic device, we may collect both PERSONAL DATA and NON-PERSONAL DATA. This data may be stored on our servers and retained for different durations of time.
Here are some types or categories of data that TRIANGLE may collect from OUR USERS.
2.1 INFORMATION YOU PROVIDE
TRIANGLE collects various bits of information provided by OUR USERS in the course of using OUR SERVICES. This includes information uploaded to our servers or otherwise provided to us when OUR USERS use a TRIANGLE brand mobile application, information provided when completing a webform on OUR WEBSITE, or information otherwise supplied by OUR USERS when engaging with TRIANGEL or OUR SERVICES in some manner. Such information may be stored on our servers to allow us to create and maintain different databases or data groups including, for example, user profiles, listings of homes offered for sale or rental, and to otherwise support operation and usage of OUR SERVICES. TRIANGLE may also collect information you share with us via SMS or other text message formats, by verbal communication, by e-mail communications, via direct message, and through any other form of communication. Please note that, when you contact TRIANGLE, we may record phone or video calls, including video and audio streams from online meeting platforms, for quality assurance. Similarly, we may record information pertaining to you and your concerns into a database to, for example, create a ticket helping to resolve any issue you might experience.
Given that we utilize information provided by OUR USERS to create user profiles, home listings, and perform other functions, you can likely guess that the information, including PERSONAL DATA, we collect will often include your full name, any contact information you furnish (e.g., an email address and/or phone number), physical addresses of real estate property you own (potentially including your primary residence), physical addresses of real estate property with which you are associated with in some manner (e.g., as a property manager or as an agent of a client who owns a home in question), your birthday or age, or any other information from which you may be personally identifiable.
To allow our software applications to operate properly, TRIANGLE also collects and stores your account log-in details, including passwords and email addresses associated with your account. OUR USERS may upload a profile picture to our servers and provide other data describing themselves. TRIANGLE collects and stores this data. Additionally, TRIANGLE may share this data with other users, such as other users with which you interact when using OUR SERVICES. For example, if you have uploaded a profile picture, provided a user handle, or provide other profile information, this information may be shared with other users with which you interact utilizing OUR surfaces or platform, such as a TRIANGLE brand mobile application. So too may such profile information be shared with other users associated with a particular home you tour, apply to rent, or perform other actions utilizing OUR SERVICES.
Some of OUR SERVICES allow OUR CUSTOMERS to perform useful functions pertaining to homes, such as creating listings of homes offered for sale or rental (the term “rental” encompassing the term “lease” throughout this document) or creating virtual work orders for home service providers to attend to certain tasks, such as a repair and maintenance tasks, in or around a home. Such information may include photos and videos of a home or the surrounding area, voice recordings, and written descriptions of a home provided by OUR USERS when creating a home listing. Various other types of information potentially gathered, stored, and shared may include contracts or letters pertaining to real estate offers and transactions, information related to your financial ability to buy or rent a home, information regarding your criminal or credit history, pre-qualification information, and information gathered for tax calculation purposes (e.g., citizenship and marital status) when so needed.
For certain USERS, such as users seeking a home to rent (herein “RENTERS”), a RENTER may fill-out an application or data fields with certain requested information, such as a credit score, reported annual income, bankruptcy information, felony or other criminal history information, general pet information, and other information usefully referenced by a property owner or manager (herein, jointly encompassed by the abbreviation (“POM”)) in evaluating whether to offer a rental lease to the RENTER. This information is typically provided by OUR USERS when creating and submitting an application for rental and may be shared to another user, such as the POM linked to the property for which the rental application was submitted, as part of OUR SERVICES.
Data pertaining to your actions performed in connection with OUR SERVICES, such as the information pertaining to the manner in which you use and navigate a TRIANGLE brand mobile application, may also be collected and stored. For example, data regarding home listings you have recently viewed, home listings you have favorited, and survey data collected regarding your opinion of a particular home or your experience utilizing OUR SERVICES may be collected, stored, and shared under certain circumstances. Often, this data is simply shared directly with the user to which this data pertains. For example, homes you favorite or recently visited or viewed utilizing a TRIANGLE brand mobile application may be categorized and made available utilizing OUR SERVICES for quick and convenient reference. Survey data may also be shared with certain users connected to a particular home subject to the survey questions, such as a POM or real agent connected to the home in question.
When uploading or otherwise providing images, (video or audio) recordings, or other data to TRIANGLE, it is important that you DO NOT provide TRIANGLE with images, recordings, or other data pertaining to other people or inadvertently capture sensitive information. Of course, please DO NOT upload images, video, or provide any other information containing offensive, sexual, or other inappropriate content. Doing so may result in immediate removal of the content, suspension of your account, and other penalties. For further detail regarding this topic, please see our TERMS OF USE.
In certain cases, TRIANGLE may perform identify verification tasks (“IDV SERVICES”) or TRIANGLE may employ the assistance of a third party to perform IDV SERVICES. IDV SERVICES may include collection of data utilized to initially establish a valid use profile, potentially including the capture of government- or state-issued documents, such as a driver’s license or passport. IDV SERVICES may further include the collection of additional data, such still images, videos, or other biometric data, which can be compared against the originally-collected data to verify a user’s identity at a later juncture in time following profile creation, such as when determining whether to grant a user physical access to a home for a walkthrough or to perform a maintenance service. By choosing to use OUR SERVICES and to provide this information to TRIANGLE, or to provide such information to a third party utilized by TRIANGLE to perform IDV services, you accept certain risks. For example, you acknowledge that no form of data repository is completely safe or invulnerable from breach; and thus assume the risk of a database breach due to hacking or other malicious activity. In event of such a data breach, you agree to agree to hold TRIANGLE harmless for any resulting damages. In turn, TRIANGLE commits to safeguarding any such data maintained in a database owned or managed by TRIANGLE to meet or exceed industry security standards.
As discussed in the foregoing paragraph, there may be scenarios in which TRIANGLE utilizes a third party to perform IDV services. In such scenarios, TRIANGLE may function as a passthrough or intermediary allowing OUR USERS to upload government identification documents, such as passports or driver’s licenses, through a TRIANGLE brand mobile application, with this data then directly provided to the third party IDV service. In such scenarios, TRIANGLE will typically not maintain a copy of your government identification document and would only obtain it from our identity verification service provider in connection with a significant trust and safety incident or if requested by law enforcement. If TRIANGLE utilizes a third party to provide IDV SERVICES, the third party will be identified to OUR USERS; and we encourage any user to please read any such third party privacy policy in detail.
2.2 INFORMATION WE MAY COLLECT FROM YOUR DEVICES
TRIANGLE may collect a wide range of information reported by your personal electronic devices, such as a tablet or smartphone executing a TRIANGLE brand mobile application. Such information can include:

Generally, this information is used for your convenience and to improve OUR SERVICES. As an example, TRIANGLE may utilize this type of information to: (i) remember your information so that you do not have to re-enter it; (ii) provide you with customized content and information, including advertising that may be particularly relevant to you; (iii) monitor the effectiveness of OUR SERVICES; (iv) monitor aggregate metrics such as total number of visitors, traffic, and usage patterns; and (v) diagnose or fix technology problems.
Again, when you access OUR SERVICES through a TRIANGLE brand mobile applications, we may receive certain mobile device data such as a unique identification number associated with your device, your device type and manufacturer, your mobile carrier, subscriber status, payment method, phone number, caller ID data, and, depending on your mobile device settings, your location information, including GPS coordinates or other data that may be utilized to determine your location. Further, when you initially launch a TRIANGLE brand mobile application or when you use it to visit a home offered for tour utilizing OUR SERVICES (herein, a “TRIANGLE HOME”), you may be asked to allow us to access your geographic location. The location of your device may also be tracked throughout the course of the time you spend in a TRIANGLE HOME including, for example, during (and perhaps for a relatively short duration of time after) a walkthrough or tour of a TIRANGLE HOME. If you initially consent to this and change your mind, you can revoke your consent by changing the geolocation preferences in your device settings; however, doing so may disrupt or disable certain aspects or functionalities of a TRIANGEL brand mobile application.
If you use our application to unlock a TRIANGLE HOME, we may collect and store data pertaining to your tour or walkthrough including, for example, the date and time the home was unlocked and the walkthrough began, the data and time the walkthrough ended, the position of your device as you progress through a home during the walkthrough, the time at which certain notifications were presented to you during a walkthrough, any chat logs or other communications sent through a TRIANGLE brand mobile application during a walkthrough, and other such information pertaining to actions or events occurring when using OUR SERVICES during a walkthrough. Further, such information may be provided to a POM, a real estate agent, or another user associated with the home subject to tour. Certain TRIANGLE HOMES may also be equipped with additional monitoring or home security technologies, such as motion sensors, video cameras, or microphones, that may be utilized to collect certain data to, for example, enhance security within the home.
2.3 INFORMATION PROVIDED BY OTHER SOURCES
In certain cases, TRIANGLE may collect information about you from our partners, service providers, and affiliated businesses in order to better provide OUR SERVICES. TRIANGLE may also utilize such data in the course of offering, or providing advertisements from third parties offering, real estate-related products and services. Such products and services may pertain to home financing, title insurance, escrow services, homebuilder partnership programs, home and yard services, home furnishings and other goods, and real estate agent partnership programs. Information pertaining to you may also be gathered from other sources, including real estate agents or other users that you have chosen to link with your TRIANGLE account or user profile.
Information we gather about you from our partners, service providers, and affiliated businesses may include Multiple Listing Service (MLS) information about your home or the home(s) you are interested in buying or renting; prequalification information, such as prequalification letters from financial institutions; construction or purchase contracts; information about the condition of, and repairs to, your home and property; information related to your home purchase, sale, moving dates, and financing in connection with helping us facilitate “trade-in” deals; and information about whether you may need homeowners insurance.
Information may also be gathered from public government sources in certain instances, which may include a tax assessment of your home; the school district and public transportation available near your home; information contained on the deed to your home, such as name, address, liens, encumbrances, and title; sale prices or current rental rates of homes similar to your home; physical information describing your home, such as the number of bedrooms and bathrooms in your home; whether your home has access to features like a beach, boat dock, or parking garage; whether your home is in an earthquake or flood zone or has any other condition that would affect its market value; government permits pertaining to your home, such as permits issued for remodels and additions; the finished and unfinished square footage of your home; and the year your home was built.
Any and all of the information above may also be provided by a licensed real estate agent on your behalf when you have selected to use a real estate agent and linked the real estate agent with a user profile associated with OUR SERVICES.
2.4 PAYMENT INFORMATION, WHEN APPLICABLE
In many instances, OUR SERVICES may be offered to OUR USERS for free, with revenue generated by advertising or in another manner. In other instances, OUR SERVICES may be offered on a payment basis. In such instances, and only with your knowledge and consent, TRIANGLE may collect and store your credit card information (e.g., your credit card number and expiration date, billing address, etc.) or other payment information, some of which may constitute PERSONAL DATA, to secure or facilitate certain payments. In addition, if you use our payment processing services, TRIANGLE may collect financial information from you (e.g., your bank account information or an address to send checks) as necessary to facilitate payments and information required for tax purposes (e.g., your taxpayer identification number). TRIANGLE may also collect or receive PERSONAL DATA including your name, email address and other contact information from third party sources, such as third party websites and marketing partners, your bank, our payment processing partners and credit reporting agencies.
3. HOW IS THE INFORMATION COLLECTED BY TRIANGLE USED?
Generally, TRIANGLE uses the information that we collect to better deliver and customize or OUR SERVICES, including to personalize features and content to you. We use the information you provide to give you options for buying, selling, renting, and servicing homes, as the case may be, believed most relevant to your individual circumstances. As discussed in Section 5 below, you have choices about how and whether we process some of your information. More specific examples of manners in which collected information, including PERSONAL DATA, might be used by TRIANGLE are listed below.
3.1 TO GATHER INFORMATION ABOUT HOMES YOU MIGHT LIKE TO RENT, SELL, OR PURCHASE
If you are interested in selling or renting out a home, we use information you provide to us about the home, including photos, videos, and user-entered data, to help us provide OUR SERVICES to OUR USERS. If you are interested in buying or renting a home, we may consider information you provide us about the home you are interested in buying or renting, including property profiles that you have indicated your interest in, to try to match you with homes you might want to purchase or rent.
3.2 TO BETTER PROTECT OUR USERS, THEIR DATA, AND THEIR PROPERTIES
TRIANGLE may utilize certain data and technologies, such as the above-described IDV services and monitoring technologies, to help keep you safe when you visit a TRIANGLE HOME and to prevent property damage, to reduce the likelihood of fraud, to enhance safety, or for other security-related purposes.
3.3 TO ADVERTISE OR TO SUPPORT TARGETED ADVERTISEMENTS BY THIRD PARTIES
TRIANGLE may use collected information to provide relevant information about additional services that TRIANGLE or our affiliated companies offer. In this regard, we use information about how you interact with our website and TRIANGLE brand mobile applications, combined with information you provide us and information we collect from other sources, to serve you relevant advertising. We may use your PERSONAL DATA for our marketing and advertising purposes, including by email, SMS marketing, display media, and targeting other devices. You may see advertisements for OUR SERVICES on third party websites, including on social media platforms. We sometimes make inferences about the type of services or products you may be interested in based upon information collected when using OUR SERVICES. We may use these inferences to help target advertising or provide customize recommendations to you, including on paid advertisers. We may do this on an aggregated or generalized basis.
3.4 FOR INTERNAL BUSINESS PURPOSES
Generally, TRIANGLE may use collected information, including PERSONAL DATA, for internal business purposes, such as helping to improve the content and functionality of OUR SERVICES, to better understand OUR USERS, to protect against or address wrongdoing, to enforce our Terms of Service, to manage your account and provide you with customer service, and to generally manage OUR SERVICES and our business.
We may use partner companies to conduct surveys of willing participants who offer suggestions as to how we might improve our Services. We also aggregate and analyze consumer information that we collect on our website, mobile applications, and from conversations with our customer service representatives to identify trends which inform how we change and grow.
We may use information about you and the manner in which your utilize OUR SERVICES to detect or prevent security incidents, protect against malicious, fraudulent, or illegal activity, and improve the security of our Services. We may also use this information to debug software by, for example, identifying and repairing errors that impair existing intended functionality.
3.5 IN CONNECTION WITH DISPUTES
We may use personal information to prosecute or defend against claims in court and other dispute resolution forums.
4. HOW AND WHY WE MIGHT SHARE YOUR INFORMATION
TRIANGLE may share collected information in the manners consistent with the goals and actions described throughout this policy. Generally, if you provide information, including PERSONAL DATA for a certain purpose, we may use or share information in connection with the purpose for which it was provided. Often, TRIANGLE may share your information, including PERSONAL DATA, when you have directed us to do so. Examples of these situations include:
Generally, then, TRIANGLE may share your information between our affiliated companies to the extent allowed by law. TRIANGLE may also share your information with service providers, including payment processors, technology and infrastructure providers, digital communications services, commercial data and market research analysts, consumer report providers, auditors and accountants, physical site security providers, IT security and bug-fix partners, customer service providers, and other providers who perform services for and on our behalf for the sole benefit of us and our customers.
If it should become necessary or appropriate, TRIANGLE may share your information with law enforcement, courts, or government agencies. In this regard, TRIANGLE may share your information as necessary to respond to legal process or to regulatory authorities (such as pursuant to a subpoena, warrant, investigative demand from law enforcement, regulators, or others; national or international security letters; etc.); to investigate, prevent, or take action regarding suspected or actual illegal activities (including fraud or stalking) and security or technical issues; to respond to or participate in commercial disputes (e.g., lawsuits or investigations); or to protect against fraud, claims, or other liability or harm to you, us, or others.
In certain circumstances, we share your information with third parties not owned by or co-branded with TRIANGLE. Examples of this type of data sharing may include:
As we develop and expand our business, TRIANGLE may sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, PERSONAL DATA may be part of the transferred assets. We may also disclose your PERSONAL DATA in the course of due diligence for such an event. You acknowledge and agree that any successor to or acquirer of TRIANGLE (or its assets) will continue to have the right to use your PERSONAL DATA and other information in accordance with the terms of this policy
5. PROTECTION OF YOUR DATA
We may store collected information, or such information may be stored by third parties associated with TRIANGLE, in accordance with the bounds and goals of this policy. We use commercially reasonable physical, electronic, administrative, and procedural safeguards to preserve the integrity, confidentiality, and security of all personal information, including PERSONAL DATA, collected through OUR SERVICES. However, no security measure, system, or control is infallible. Therefore, as is the case for essentially all businesses offering software applications or otherwise operating over the Internet, we cannot and expressly do not guarantee that OUR SERVICES, our databases, or the databases of any affiliate, such as a third party IDV service, are invulnerable to attack or misuse. Please know that you accept and assuming this risk of data exposure due to hacking or other data breach by choosing to utilize OUR SERVICES.
Additionally, no network, server, database or Internet or email transmission is ever fully secure or error free. Therefore, you should take special care in deciding what information you send to us electronically. Please keep this in mind when disclosing any PERSONAL DATA.
5.1 CHOICES IN CONTROLLING USAGE OF YOUR DATA
You are in the best position to control the security and privacy of your own information. First, please do not use OUR SERVICES if you are not comfortable with and are not in full agreement with the terms of this policy. If you feel uncomfortable with this policy or the manner in which we may use your data, please do not create an account. If desired, you can perform various actions using OUR SERVICES prior to creating an account.
More generally, you should not provide us with PERSONAL DATA that we do not request. As noted above, you should take care when uploading data to TRIANGLE to avoid disclosing unneeded PERSONAL DATA as might be inadvertently captured in photos or video clips; and you should not upload images or data of other individuals. When you provide data to another user a TRIANGLE brand mobile application, you do so at your own risk. Additionally, you are responsible for controlling access to any personal computing device through which your information may be stored or accessed. You are also responsible for safeguarding any passwords or other log-in credentials that may be used to access your information, including in the TRIANGLE environment. TRIANGLE recommends that you log out of any account when you are done using it, that you select high strength passwords, and that you change your passwords with frequency.
5.2 KNOW THE PRIVACY POLICIES OF THIRD PARTIES
Please remember to review the privacy settings and security policies of third-party sites and services that you use, such as social networks. We are not responsible for the privacy or security measures of any third party, including third parties that advertise through TRIANGLE or are otherwise affiliated with TRIANGLE in some manner.
5.3 INCIDENT RESPONSE
In the event that the security of any personal information under our control is compromised, TRIANGLE will take reasonable steps to investigate and mitigate the situation, including, when appropriate, notifying those individuals whose information may have been compromised and taking other steps in accordance with applicable laws and regulations.
5.4 DO NOT TRACK
Please be aware that OUR SERVICES, including our website (LetsTriangle.com), does not currently support any “Do Not Track” features or frameworks.
6. OPTING OUT OF OUR COMMUNICATIONS, DELETING YOUR ACCOUNT, AND PERSONAL DATA RETENTION
TRIANGLE does not wish to send communications to any users that a user finds to be a nuisance or not useful in some manner. Please always do not hesitate to take those steps necessary to stop undesired communications from TRIANGLE or a third party associated with TRIANGLE, such as unsubscribing from any marketing communications we may send. All marketing emails will include unsubscribe links and any marketing texts can be halted by returning a text message stating “STOP.”
If no longer wish to use a TRIANGLE brand mobile application, we are sorry to see you go. Please follow the usual process to uninstall the application from your device. We may retain information pertaining to you, including your PERSONAL DATA, for at least as long as you are registered to use OUR SERVICES. You may delete your account any time utilizing a TRIANGLE brand mobile application. However, in this event, we may retain PERSONAL DATA for an additional period as is permitted or required under applicable laws. Even if we delete your PERSONAL DATA it may persist on backup or archival media for an additional period of time for legal, tax or regulatory reasons or for legitimate and lawful business purposes.
7. EXCLUSIONS
7.1 PERSONAL DATA AND NON-PERSONAL DATA PROVIDED TO OTHERS
This policy does not apply to any information, including PERSONAL DATA, that you provide to another user through OUR SERVICES or through any other means, including by communications through a TRIANGLE brand mobile application.
7.2 THIRD PARTY LINKS AND WEBSITES
This policy applies only to OUR SERVICES. In certain instances, OUR SERVICES may contain links to other websites not operated or controlled by us (the "Third Party Sites"). The policies and procedures we described here do not apply to the Third Party Sites. Any such links do not imply that we endorse or have reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies.
8. CHILDREN’S ONLINE PRIVACY PROTECTION ACT
We do not knowingly collect PERSONAL DATA from children under the age of thirteen (13); nor are OUR SERVICES intended for usage by anyone under the age of eighteen (18). If you are under the age of thirteen (13), please do not submit any PERSONAL DATA through OUR SERVICES or use OUR SERVICES in any way. We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce our policy by instructing their children never to provide PERSONAL DATA through OUR SREVICES without their permission. If you have reason to believe that a child under the age of 13 has provided PERSONAL DATA to us through OUR SERVIC|ES, please contact us at PrivacyandLegal@LetsTriangle.com so we may take appropriate actions, such as deleting any such information from our databases.
9. NOTES FOR GEOGRAPHICALLY-SPECIFIC USERS
9.1 USERS LOCATED OUTSIDE OF THE UNITED STATES
OUR SERVICES, our platform for providing OUR SERVICES, and our business is operated and hosted within the United States and is not intended for use outside of the United States.
If you are accessing OUR SERVICES from other jurisdictions, please be advised that any personal information you provide to us is being transferred to the United States by, for example, sending information (including PERSONAL DATA) to the United States where our servers are located. That information may then be transferred within the United States or back out of the United States to other countries outside of your country of residence, depending on the type of information and how it is stored by us. These countries (including the United States) may not necessarily have data protection laws as comprehensive or protective as those in your country of residence; however, our collection, storage and use of your PERSONAL DATA will at all times continue to be governed by this policy. By using OUR SERVCIES, you consent to that transfer and to the use of your personal information in accordance with this policy.
